This privacy policy (“Policy”) has been implemented and provided in order for you to understand how we collect, use, disclose, manage and protect your personal information, throughout your interaction with Qnovate via our website (www.Qnovate.com) (“Website”), network applications, or other interactive services. This Policy also covers the information we may collect offline, such as when you telephone us, visit us in person or interact with us at an event. By using the Website or otherwise interacting with Qnovate you agree to the practices outlined in this Policy. If you do not agree, you should not interact with the Website or otherwise provide Qnovate with your personal information.
Collection of Personal Information
What is personal information/personal data?
Personal information/data is information about you as an identified or identifiable individual. The definition of personal information/data may vary depending on your jurisdiction. For purposes of the Personal Information Protection and Electronic Documents Act (“PIPEDA”), it is information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization. In the United States, personally identifiable information (“PII”) is any data that could potentially identify a specific individual. Under the California Consumer Privacy Act (“CCPA”)of 2018 (“CCPA”), personal information is information that identifies, relates to, describes, or is reasonably capable of being associated with, or could reasonably be linked with a particular consumer or household. Under the General Data Protection Regulation (“GDPR”), personal data includes work email addresses containing a business partner’s name or any business contact information tied to or related to an individual (ex. name, job title, company, business address, work phone number etc.).
Aggregated, statistical or de-identified information is not considered personal information/data, and information/data generated through your use of our Website is not personal information/data unless we can combine it with other information that would identify you.
Whom does Qnovate collect information from?
Qnovate may collect information from several different entities including, prospective employees, current employees, former employees, contractors, subcontractors, consultants, customers, prospective customers, or individuals and representatives who visit the Qnovate website, or register to receive notifications and/or product/services from Qnovate.
What type of information does Qnovate collect and how is it collected?
Qnovate may collect information that has been provided to us directly by you when you apply for a position, do business with or make a purchase from Qnovate, register an account with us, communicate with us through email, chat, fax, or phone, or access our website. This information may include your name, email, information you choose to include in the body of your email, postal/shipping/billing address, IP address, phone number, employee identification number, financial information, such as credit card numbers or bank details, business information, commercial information such as records of products or services purchased, internet or network activity such as browsing or search history, or any other information voluntarily disclosed by you.
Cookies
Like many websites, our website requires that you accept cookies in order to use it. Cookies are small text files that are placed on your computer by websites that you visit to automatically collect information. They are stored on your computer's hard drive and enable the website to recognize you. Cookies do not contain any personal details.

How does Qnovate use this information?Qnovate's primary goal in collecting personal information is to provide users with a customized experience.
Qnovate may use your information for the following purposes:
- • Personalizing customer experiences via customer registration on Qnovate’s website;
- • Employee and customer administration;
- • Processing requests, purchases/orders, payments and to prevent fraud;
- • Maintaining contact directories;
- • Advertising or marketing and gathering customer interests;
- • Complying with applicable contracts, legal and regulatory requirements; or
- • Conducting customer surveys (customer satisfaction surveys; qualitative market research).
Disclosure of Personal Information
When will Qnovate share/disclose this information?Qnovate will disclose personal information solely for the purposes for which it was collected, as identified within this Policy and/or with the consent of the individual whose personal information was collected. Qnovate may be required to disclose your purchase information to business partners in connection with your purchase of certain products or services. As an example, many software publishers require us to provide them with information regarding the purchase of their products for, among other things, delivery, registration and/or license purposes. In many cases, we are contractually obliged to provide this information and may provide information to our business partners who work with Qnovate if that information is necessary in order for that work to be done or in connection with a merger, sale, acquisition of assets, or corporate reorganization.
Qnovate may transfer personal information to trusted third parties for processing and storage purposes. Such personal information may be transferred across state/provincial and national borders, in which case, the information may become subject to the legislation of the jurisdiction to which it has been transferred. Qnovate will only transfer personal information to third parties who keep the information we send them confidential and secure and for the sole purpose of performing their functions for Qnovate.
Management/Protection of Personal Information
How does Qnovate manage/protect this information?Qnovate takes administrative, technical, and tangible security precautions to protect any personal information under our control from loss, theft, unauthorized use, access, disclosure, destruction and other online threats. Qnovate supports and endorses modern browsers with 128-bit encryption, and uses Secure Socket Layers. Additionally, Qnovate retains personal information only as long as necessary for the fulfillment of the uses as outlined in this Policy. After expiry of the retention periods, your personal information will be deleted or anonymized in accordance with applicable policies or agreements. If there is any information that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of the data.
Update/Correction of Information or Opt-Out
How do I opt out of receiving further communication from Qnovate?Qnovate may periodically send you email regarding products and services. Additionally, if you have indicated upon registration that you are interested in receiving offers or information from Qnovate and/or our partners, we may send you direct mail about such products and/or services that may be of interest to you. You may opt out of receiving these emails or direct mail from Qnovate by following unsubscribe instructions provided within such correspondence or unsubscribe on our website.
How do I access/update/correct or delete my personal information?You may have certain rights to access, update and correct the personal information we have collected from you. To request that Qnovate provide access to, update, correct and/or delete your personal information in our system, please contact us at info@Qnovate.com. You can also update certain information by logging into your account. We may deny your deletion request if retaining the information is necessary for us or our service provider(s), to the extent permitted by applicable law.
California Consumer Privacy Act (“CCPA”)Privacy Rights
If you are a consumer who is a US resident, you may have the right to request that Qnovate disclose certain information to you about our collection and use of your personal information over the past 12 months. General Data Protection Regulation (“GDPR”) Privacy Rights
The personal information of residents subject to the GDPR may be processed outside the European Economic Area. Sharing with Event Sponsors
We may provide your contact information (name, company, email address) that we collect within the framework of a demo, session, activity or event (“Event”) to which you register with the identified sponsors/partners of that event (“Event Sponsors”) if (a) you register for an Event involving such Event Sponsors (in which case we would provide your contact information only to the Event Sponsor involved in such Event and only for the identified purpose); or (b) you opt in during registration or otherwise consent to receive further communications from the Event Sponsor. Event Sponsors will use your personal data in accordance with their own privacy policies.
Children
Protecting the safety of children when they use the Internet is very important to us. The Website is not designed or intended for use by children or anyone under the age of 16. Qnovate does not knowingly collect information from children.
Call Recording
If you are a managed services customer, your incoming calls to Qnovate’s Technical Support Center may be recorded for quality assurance and/or coaching purposes. When your call is recorded, you will be notified at the beginning of the call. We collect your phone number and recording of the incoming call conversation. We do not record any payment information. We will only disclose a recording with your explicit consent or if we are legally required to. You may request to your Qnovate Technical Support Agent that your incoming call not be recorded, in which case we call you back on an unrecorded phone call. Recordings are kept securely and deleted after 30 days.
Changes to this Policy/Questions
Qnovate may change this Policy from time to time. Please note the “Last Updated” note below to see when the most recent version was revised. Data Protection
At Qnovate we take data protection as seriously as our customers. The content on this page provides an overview of how we manage your personal data, your rights in respect of that data, and how it applies to the various engagements we have with our customers.
The kind of Personal Information/Data Qnovateholds
For most individuals Qnovate only holds limited personal information/data. This typically includes a person’s name, job role, business email and phone numbers.
Data exchange with most customers is limited to email, instant messenger and phone conversations. We only record phone calls in accordance with applicable legislation and any communication over email is automatically added to our corporate archive. We use a solution that permits us to retrieve and remove data from this archive when required.
Some of our professional and managed services offerings permit other methods of data exchange. Customers requiring more information on data protection in these scenarios should initially contact their account or service delivery manager.
How Qnovate has approached updates to Privacy Legislation
Prior to the General Data Protection Regulation (“GDPR”) going into effect on May 25th, 2018, Qnovate undertook a companywide review of data protection to ensure our compliance with the GDPR. In line with the GDPR requirements, we documented our processing activities as a data controller and as a data processor. Where required, we have updated contracts with business partners to cover data protection obligations.
With ongoing oversight from our CFO and with the support of an internal GDPR project team, our Legal and IT departments have reviewed how they interact with data subjects and their personal data in both internal and customer facing systems.
As part of our ongoing commitment to data protection, we constantly review and enhance our data protection practices to keep with the key principles of GDPR, as well as other applicable privacy legislation, such as the California Consumer Privacy Act (“CCPA”), which went into effect on January 1, 2020.
We continue to work to ensure the security of our systems and the data contained within. Further information on our security program is available upon request.
Your Rights under the CCPA
If you are a consumer who is a California resident, you may have the right to request that Qnovate disclose certain information to you about our collection and use of your personal information over the past 12 months, namely:
1. The categories of personal information we have collected about you;
2. The categories of sources from which the personal information is collected;
3. The business or commercial purpose of collecting personal information;
4. The categories of third parties with whom we share personal information; and
5. The specific pieces of personal information we have collected about you.

We will endeavor to respond to a verified consumer request within 45 days of receipt, depending on the nature and complexity of your request. If we require more time, we will inform you in writing. We will not discriminate against you for exercising any of your rights under the CCPA.
Third-Party Cloud / Hosted Services
Like purchasing hardware and software, Qnovate places an order with a vendor with a limited amount of personal data required to fulfil that order. Typically, this is limited to the name, email address and phone number of a license to and/or ship to address/contact.
The vendor becomes the data controller of this information and may use it to contact individuals outside of Qnovate’s control for purposes such as sharing product information, marketing, providing support and renewals.
Depending on the service and data involved, the vendor may be considered a data processor to the subscriber organization under the GDPR. In these scenarios, vendors may offer data processing terms in their standard terms and conditions or as part of a data processing addendum.
Professional and Managed Services
Qnovate offers a wide range of professional and managed services to support our customers’ operations. Depending on the service, it is possible we, or the supplier providing the service may receive personal information/data from your organization. The delivery of services may involve the use of subcontractor and if so, this will be made clear in our contract for such services.
Qnovate is pleased to enter into data processing agreements/addenda (“DPA”), or other relevant contractual agreement/clauses so customers can ensure our compliance with applicable privacy laws. Qnovate also ensures that our subcontractors are bound to such agreements that require they protect the data shared to the same standards customers can expect from Qnovate.
We work tirelessly to ensure the security of the managed service platforms that we run for customers. To attest to this, we regularly undertake internal audits and external testing engagements with third parties. Our managed services are SOC 1 Type 2 compliant and we complete an annual third-party penetration test of our environments.
If your organization has specific requirements around data protection above and beyond compliance with the relevant laws, including GDPR or CCPA, these should be shared with your Qnovate Account Manager or Service Delivery representatives.
Hardware and Software Licensing
When Qnovate places an order with a supplier, we supply them with a limited amount of personal customer information required to fulfil that order. Typically, this is limited to the name, email address and phone number of a license to and/or ship to contact. At that point, the vendor becomes the data controller of this information and may use it to contact individuals outside of Qnovate’s control for purposes such as sharing product information, marketing, providing support and renewals.
How do I acquire the software I just ordered?
Dependent on the terms and conditions for the software license provider, you may receive an email directly from the software license provider with details to access licensing.
For some software license providers, an email is only sent at the time of initial agreement/contract creation. For subsequent orders, emails may not be sent but licensing will be available to provision from the time of invoicing within a vendor portal that you will be able to log into and provision from.
What do I do if I have problems downloading software?
In the event you have not received details on how to access your licensing and/or need assistance with accessing, please log into Qnovate.com, pull up the invoiced order within Qnovate.com, and request a licensing order update. Our Customer Operations team will assist with retrieving missing license access details.
